1. Acceptance of Terms & Eligibility

  1. Agreement Binding: By accessing this website or making a purchase, you agree to be bound by these Terms of Service and the Tatcha Privacy Policy. If you do not agree to all the terms of this Agreement, please discontinue your use of this website immediately.
  2. Age Restriction: You must be at least 18 years of age (or the legal age of majority in your jurisdiction) to use this website or create an account.
  3. Modifications: Tatcha reserves the right to modify or update these terms at any time. Changes will be effective immediately upon posting to the website. Your continued use of the website following any modifications constitutes your acceptance of the revised terms.

2. Account Registration & Security

  1. Account Information: To access certain features (such as tracking orders, managing subscriptions, or participating in loyalty programs), you may be required to register an account. You agree to provide accurate, current, and complete personal and billing information, and to update it promptly.
  2. Password Security: You are responsible for maintaining the confidentiality of your account password and login credentials, and you accept full responsibility for all activities that occur under your account. Notify Tatcha immediately of any unauthorized use or security breaches.

3. Product Purchases & Sales Terms

  1. Personal Use Only: Products and services available on the Tatcha website are for personal use only. Commercial resale, redistributing, or unauthorized bulk purchasing is strictly prohibited. Tatcha reserves the right to cancel or limit orders suspected of violating this policy.
  2. Order Acceptance & Cancellation:
    • An automated order confirmation email does not constitute final acceptance of a sales contract by Tatcha.
    • Tatcha reserves the right to refuse service, limit order quantities, or cancel orders at any time without prior notice (including due to pricing errors). If your credit card has already been charged and your order is cancelled, we will issue a prompt refund to your original payment method.
  3. Pricing & Payment: All prices are listed in US Dollars (or other specified currencies). Payment terms are subject to change by Tatcha and apply to orders placed at the time of the transaction.

4. Subscriptions & Auto-Refill Plans

If you choose to participate in the Tatcha Auto-Refill subscription plan, the following terms apply:

  1. Automatic Billing & Delivery: Your payment method will be automatically charged at the frequency and for the product selections you chose during registration or in your account preferences.
  2. Cancellations & Modifications: You may cancel or modify future subscription orders at any time up to 24 hours prior to your next scheduled billing or shipping date by logging into your Tatcha account.

5. Returns & Happiness Guarantee

  1. US Domestic Returns: Tatcha offers a 60-day return policy from the date of purchase for domestic US orders (including APO/FPO/DPO and US territories). Eligible returns can generate a free UPS prepaid return label via our website, and a full refund will be issued to the original payment method upon receipt.
  2. After 60 Days: Orders exceeding 60 days from the purchase date are no longer eligible for returns, exchanges, or store credit.
  3. International Returns: Return shipping costs for international orders are the buyer’s responsibility. Please contact customer service for specific instructions.

6. Intellectual Property

All content included on this website—including text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software—is the property of Tatcha or its content suppliers and is protected by United States and international copyright, trademark, and other intellectual property laws. Any disputes arising out of or relating to this Agreement or your use of the Tatcha website shall first be resolved through good-faith negotiation. If unsuccessful, disputes shall be submitted to binding arbitration on an individual basis (waiving any right to a jury trial or class action to the fullest extent permitted by law).
